1. Nature of the Experience

NamMads organises and facilitates small-group, photography-focused travel experiences that include informal instruction, creative guidance, mentorship, and practical photography training delivered in real-world environments.

 

Instruction is provided in a hands-on, experiential manner and is intended for general educational and recreational purposes only. These experiences do not constitute formal education, accredited training, professional certification, or qualification of any kind.

 

Participation is voluntary. Participants remain responsible for their own decisions, conduct, and safety at all times during the experience.

 

  1. Payments, Deposits and Booking

 

2.1  Deposit to Secure Your Spot

A non-refundable deposit of 50% of the total tour price is required to confirm and secure your place on the NamMads November 2026 tour. No booking is confirmed until the deposit has been received and acknowledged in writing by NamMads.

 

2.2  Balance Payment

The remaining 50% balance is due no later than 30 days before the scheduled tour departure date — by 16 October 2026.

 

Important — Late Payment

If the balance is not received by 16 October 2026, your deposit will be forfeited in full and your spot will be released without further notice.

NamMads reserves the right to offer the spot to another participant once this deadline has passed.

 

2.3  Payment Methods

Accepted payment methods and banking details will be provided upon booking confirmation. All payments must be made in South African Rand (ZAR) unless otherwise agreed in writing.

 

  1. Refunds and Cancellations

 

NamMads Refund Policy — Please Read Carefully

Once payment has been made — whether deposit or balance — no refunds will be issued under any circumstances, except in the single case described in Section 3.2 below.

This policy exists because costs are committed well in advance of the tour date and cannot be recovered.

 

3.1  Participant Cancellation — No Refund

If you choose to cancel your booking for any reason — including personal circumstances, illness, work commitments, change of plans, travel disruptions, or any other cause — no refund will be issued on any amount paid.

 

This applies to both the deposit and the balance. No credits, transfers, or carry-overs to future tours will be offered.

 

3.2  NamMads Cancellation Due to Illness or Incapacity

In the event that NamMads is unable to operate the tour due to the illness or incapacity of the tour guide, a full refund of all amounts paid will be issued to all confirmed participants within 14 business days of the cancellation notice.

 

This is the only circumstance under which a refund will be provided.

 

3.3  Force Majeure and Other Cancellations

NamMads reserves the right to cancel, postpone, or modify the tour due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, political instability, government travel restrictions, border closures, or other force majeure events.

 

In such cases, NamMads will make every reasonable effort to offer an alternative date or credit toward a future tour. Refunds in force majeure circumstances are not guaranteed and will be assessed on a case-by-case basis.

 

3.4  Non-Transferability

Bookings are personal and non-transferable. Your confirmed spot may not be passed, sold, or transferred to another person without prior written approval from NamMads.

 

  1. Itinerary Changes

NamMads reserves the right to modify itineraries, locations, schedules, or activities at any time due to safety concerns, weather conditions, logistical constraints, local regulations, or circumstances beyond reasonable control. Such changes do not entitle participants to any refund or compensation.

 

  1. Assumption of Risk

The participant acknowledges that international travel, photography activities, and participation in unfamiliar urban and rural environments inherently involve risks, including but not limited to illness, injury, accidents, crime, transportation incidents, environmental hazards, natural disasters, and death.

 

The participant voluntarily assumes all risks associated with participation in the experience, whether foreseeable or unforeseeable, and agrees that NamMads, its organisers, representatives, and affiliates shall not be held liable for any loss, damage, injury, or death sustained during or in connection with the experience.

 

  1. Limitation of Liability

 

6.1  Instructional Limitation

Instruction, guidance, and mentorship provided during the experience are based on personal knowledge and experience and are offered without warranty or guarantee of results. NamMads makes no representations regarding individual improvement, professional advancement, commercial success, or specific outcomes resulting from participation.

 

6.2  Third-Party Services

NamMads is not responsible for the acts, omissions, negligence, or failures of third-party service providers, including but not limited to accommodation providers, transport operators, visa agents, or local service suppliers.

 

6.3  Operator Status

NamMads is not a licensed tour operator in Vietnam and does not operate as a local tourism business within Vietnam. All services are organised and sold outside of Vietnam.

 

  1. Medical Fitness and Travel Insurance

 

7.1  Medical Fitness

By confirming your booking, you confirm that you are medically, physically, and mentally fit to participate in the experience and have disclosed any relevant medical conditions to NamMads prior to departure.

 

7.2  Travel Insurance

Comprehensive travel insurance is strongly recommended for all participants. Your insurance should cover medical expenses, emergency evacuation, personal liability, trip cancellation, and loss of personal belongings. Failure to obtain adequate insurance is solely the responsibility of the participant.

 

  1. Visas and Travel Documents

The participant is solely responsible for obtaining and maintaining valid passports, visas, and all travel documents required for entry into Vietnam. Any assistance provided by NamMads with visa applications is offered as a courtesy only. NamMads does not guarantee visa approval and accepts no responsibility for visa refusals, delays, or immigration decisions.

 

  1. Photography and Media Release

The participant grants NamMads permission to use photographs or video footage in which they appear, captured during the experience, for marketing, promotional, and educational purposes across NamMads platforms including but not limited to the website, Instagram, and email communications.

 

If you do not wish to appear in NamMads marketing materials, you must notify NamMads in writing before the tour commences.

 

  1. Governing Law and Jurisdiction

This agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with this agreement shall be subject to the exclusive jurisdiction of South African courts.

 

  1. Acceptance of Terms

By making a deposit payment, the participant confirms that they have read, understood, and agreed to all terms and conditions contained in this document in full.
